Introduction

Welcome to Flow, a mobile application designed to reward users for exploring destinations and interacting with merchants by scanning QR codes and earning points that can be redeemed for various rewards. These Terms of Use ("Terms") govern your use of the Flow app ("the App"). By registering an account or using the App, you agree to these Terms. If you do not agree to these Terms, you should not use the App.

1. Acceptance of Terms

By using Flow, you confirm that you are at least 18 years of age, and you accept and agree to be bound by these Terms. If you are under 18, you may not use this App. These Terms may be updated from time to time without prior notice. Continued use of the App constitutes your acceptance of the revised Terms.

2. Registration and Account Responsibilities

2.1. User Registration

To use certain features of Flow, you must create an account. When creating an account, you agree to provide accurate, current, and complete information, including your full name, date of birth, nationality, email address, phone number, and city of residence.

2.2. Account Security

You are responsible for maintaining the confidentiality of your account credentials (e.g., OTP, passwords) and for all activities that occur under your account. Flow will not be liable for any loss or damage arising from unauthorized access to your account. You agree to notify us immediately of any unauthorized use of your account or any breach of security.

2.3. Account Deactivation

Flow reserves the right to suspend, restrict, or terminate your account at any time for violations of these Terms, misuse of the App, fraudulent activity, or other actions that could harm Flow or its users.

3. User Responsibilities

3.1. Prohibited Activities

You agree not to engage in the following activities while using Flow:

• Using      the App for any illegal or unauthorized purpose.
• Falsifying      personal information, such as providing fake name, email, or phone number.
• Circumventing      or attempting to bypass any security measures of the App.
• Engaging      in fraudulent activities, including falsifying scans or tampering with QR      codes.
• Scanning      QR codes without physically being present at the merchant location, using      GPS spoofing, or any other method to falsely gain points.
• Interfering      with the operation of the App, including hacking, introducing malware, or      other harmful activities.
• Violating      any applicable laws, rules, or regulations in the Kingdom of Saudi Arabia      while using the App.

3.2. Use of Points

Points collected within Flow are for personal use only and cannot be transferred, sold, or redeemed for cash. You agree to use the points for redeeming rewards through the App in accordance with the rules and restrictions outlined for each reward.

3.3. Responsible Use

You agree to use the App responsibly and to respect the locations, merchants, and rewards provided through the Flow platform. Merchants have the right to refuse to honor rewards if fraudulent behavior or misuse is suspected.

4. Merchant Interactions

4.1. Merchant Responsibility

Flow allows users to interact with participating merchants by scanning QR codes at their physical locations to earn points. Flow is not responsible for the actions, offers, or goods and services provided by merchants. Each merchant is responsible for their own operations, promotions, and rewards.

4.2. Merchant-User Disputes

Flow is not responsible for resolving disputes between users and merchants regarding offers, QR code scanning, or rewards. If you encounter issues with a merchant or reward, we recommend that you contact the merchant directly.

5. Rewards and Redemption

5.1. Reward Availability

Rewards are offered by merchants through the App. Flow does not guarantee the availability of specific rewards, and merchants reserve the right to modify, replace, or discontinue rewards at any time without prior notice.

5.2. Points and Reward Redemption

Points earned by scanning QR codes can be redeemed for rewards within the App. Each reward has a designated points value, and points will be deducted from your balance upon redemption. All redemptions are final, and points cannot be refunded once a reward is claimed.

5.3. Expiration of Points

Points may expire if not redeemed within a certain time period as determined by Flow. Flow reserves the right to modify the expiration period at any time. Users will be notified of any changes to point expiration policies.

6. Data Collection and Privacy

6.1. Data Collection

By using the App, you agree to the collection, use, and processing of your personal data in accordance with our Privacy Policy. Flow collects data such as name, email, location, and QR code interactions for the purpose of providing and improving the App’s services. You acknowledge that your personal data may be shared with merchants for purposes related to the services provided by Flow.

6.2. Location Data

Flow uses location data to identify nearby QR code hotspots and ensure that QR codes are scanned in valid locations. By using Flow, you consent to the collection and processing of your real-time location data. You can manage location permissions in your device settings.

6.3. Data Retention

We will retain your personal data for as long as necessary to provide the services of the App or as required by applicable laws in the Kingdom of Saudi Arabia. You may request the deletion of your personal data as outlined in the Privacy Policy.

7. Intellectual Property

7.1. App Content

All content, trademarks, service marks, logos, designs, text, graphics, software, and other material ("Content") within the App are owned by Flow or its licensors. You may not use, copy, reproduce, modify, or distribute any part of the Content without prior written consent from Flow.

7.2. User-Generated Content

You may have the ability to upload or submit certain content to Flow, such as feedback or reviews. By submitting content, you grant Flow a non-exclusive, royalty-free, perpetual license to use, modify, and display the content in connection with the operation and promotion of the App.

8. Limitation of Liability

To the maximum extent permitted by law, Flow will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your      use of or inability to use the App.
• Errors,      mistakes, or inaccuracies in the content.
• Unauthorized      access to or alteration of your account or personal data.
• Any      actions or conduct of any third party in connection with the App,      including merchants or other users.

Flow's liability will be limited to the amount you have paid, if any, for use of the App.

9. Termination

Flow reserves the right to suspend or terminate your access to the App at any time, without notice or liability, for any reason, including but not limited to violations of these Terms or suspected fraudulent activity. Upon termination, your account and any points earned will be forfeited, and you will no longer have access to the App.

10. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of Saudi Arabia.

11. Amendments to Terms

Flow may update or modify these Terms of Use at any time. Any significant changes will be communicated to users within the App or via email. Continued use of the App after the changes have been made constitutes acceptance of the new Terms.
